You may not use such marks without our prior written permission. Other names, logos, and brands are the property of their respective owners. 4.3 Limited License Nothing in these Terms grants you any right, title, or interest in the Website or any Content, except for the limited license to access and use the Website as expressly set forth herein. 4.4 Copyright Complaints We respect the intellectual property rights of others. If you believe any Content on the Website infringes your copyright, please contact us at legal@metadock.app with: a) Identification of the copyrighted work claimed to have been infringed; b) Identification of the allegedly infringing material and its location on the Website; c) Your contact information (address, telephone number, email); d) A statement that you have a good faith belief that the use is not authorized; e) A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner; f) Your physical or electronic signature. 5. PRODUCT INFORMATION AND AVAILABILITY 6.1 Product Descriptions We attempt to be as accurate as possible in describing MetaDock and our services on the Website. However, we do not warrant that product descriptions, features, specifications, pricing, or other Content is accurate, complete, reliable, current, or error-free. 6.2 Pricing All prices displayed on the Website are in U.S. Dollars (USD) unless otherwise specified and are subject to change with notice as described in Section 14 of these Terms. Current pricing is available at the pricing page. 6.3 Availability MetaDock is currently available for Windows 10 and Windows 11 only. We make no representation that the software will be available for other operating systems or platforms. 6.4 No Guarantee of Features Features described on the Website, particularly features marked as "Coming Soon" or with future dates (e.g., "Coming Q2 2026"), are not guaranteed and may be modified, delayed, or cancelled without notice. 8. HEALTH AND SAFETY WARNING PHOTOSENSITIVE SEIZURE WARNING: A small percentage of people may experience seizures when exposed to certain visual elements, including flashing lights or patterns that may appear on computer screens. This may occur when using MetaDock, particularly when: - Multiple browser windows or applications update simultaneously - Viewing web content with animations or flashing elements - Rapidly switching between windows or workspaces - Auto-refresh features cause repeated page reloads If you or any family member has a history of seizures or epilepsy, consult a physician before using MetaDock. DISCONTINUE USE IMMEDIATELY and consult a physician if you experience any of the following symptoms: - Dizziness, altered vision, or eye twitching - Muscle twitching or involuntary movements - Loss of awareness, confusion, or disorientation - Convulsions or seizures TO REDUCE RISK OF PHOTOSENSITIVE SEIZURES: - Use MetaDock in a well-lit room - Take regular breaks (at least 15 minutes every hour) - Avoid prolonged use when tired - Reduce the number of simultaneously active/updating windows - Disable auto-refresh features if you are sensitive to screen flicker REPETITIVE STRAIN AND EYE STRAIN: Extended computer use may cause discomfort in hands, wrists, arms, shoulders, neck, or eyes. To reduce risk: - Take regular breaks and stretch - Maintain proper posture and ergonomic setup - Adjust screen brightness and use appropriate lighting - Consider using blue light filtering if using MetaDock for extended periods Gammal Software, Inc. is not responsible for any health issues arising from use of MetaDock. 9. BROWSER AUTOMATION & WEB SCRAPING MetaDock provides browser automation features including programmatic navigation, element interaction, JavaScript execution, and data extraction. These features are provided for legitimate purposes such as software testing, authorized research, productivity enhancement, and personal automation. YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR USE OF AUTOMATION FEATURES COMPLIES WITH: (a) All applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), the Canadian Criminal Code provisions on unauthorized computer access, and equivalent laws in your jurisdiction. (b) The Terms of Service of any websites or online services you interact with using MetaDock. (c) All applicable data protection and privacy laws when collecting or processing any data. Gammal Software, Inc. is not responsible for any consequences arising from your use of automation features, including but not limited to legal action, account suspensions, access restrictions, or civil or criminal liability. 10. THIRD-PARTY PLATFORM COMPLIANCE MetaDock's profile isolation, User-Agent customization, and multi-browser capabilities are designed for legitimate use cases such as web development testing, managing separate personal and professional accounts on platforms that permit this, and privacy protection. Many online platforms prohibit operating multiple accounts, using automation, or misrepresenting your identity or device characteristics. You are solely responsible for understanding and complying with the terms of service of any platform you access through MetaDock. Gammal Software, Inc. disclaims all liability for account suspensions, bans, legal action, or other consequences resulting from your violation of third-party platform terms. 11. THIRD-PARTY APPLICATIONS MetaDock allows embedding third-party Windows applications within its workspace. When you embed third-party applications: (a) You are responsible for ensuring you have the right to use those applications in this manner. (b) You must comply with all license agreements and terms of use for embedded applications. (c) Gammal Software, Inc. makes no representations about the compatibility, stability, or authorization to embed any third-party software. (d) Embedding an application does not grant you any additional rights to that application beyond what its own license provides. Gammal Software, Inc. is not responsible for any issues, data loss, or license violations arising from embedding third-party applications. 12. THIRD-PARTY LINKS AND SERVICES 7.1 Third-Party Links The Website may contain links to third-party websites, services, or resources ("Third-Party Links"). These links are provided for your convenience only. 7.2 No Endorsement The inclusion of Third-Party Links does not imply endorsement, approval, or recommendation by the Company. You assume all risk associated with downloading and installing software from the Website. 9.3 Security Precautions We recommend that you: a) Use reputable antivirus software; b) Verify the digital signature of downloaded files; c) Download only from official metadock.app domains; d) Keep your operating system and security software up to date. 9.4 Microsoft SmartScreen MetaDock is a new application and may trigger Microsoft SmartScreen warnings. This is normal for new software. You can verify the file's digital signature and publisher information before installation. 15. DISCLAIMERS AND WARRANTIES 10.1 "AS IS" AND "AS AVAILABLE" BASIS THE WEBSITE AND ALL CONTENT, SERVICES, AND MATERIALS PROVIDED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 10.2 Disclaimer of Warranties TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMMAL SOFTWARE, INC. DISPUTE RESOLUTION AND GOVERNING LAW 13.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. 13.2 Mediation Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Website through good-faith mediation. a) Either party may initiate mediation by providing written notice to the other party at legal@metadock.app (for notice to Company) or your registered email address (for notice to you). b) The parties will jointly select a mediator within 14 days of the mediation notice. c) If the parties cannot agree on a mediator, either party may request appointment of a mediator through the ADR Institute of Canada or similar recognized mediation service. d) Mediation costs will be shared equally between the parties unless otherwise agreed. e) If mediation does not resolve the dispute within 60 days of the first mediation session, either party may proceed to litigation. 13.3 Jurisdiction and Venue If mediation is unsuccessful, any legal action or proceeding relating to these Terms or the Website shall be brought exclusively in the courts of competent jurisdiction in the Province of Ontario, and you irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts. 13.4 Individual Proceedings (Except Where Prohibited) Where permitted by applicable law, the parties agree that any dispute resolution proceedings will be conducted on an individual basis. However, this provision does not apply in jurisdictions where class action waivers are prohibited or unenforceable, including Canada. Nothing in these Terms prevents you from participating in a class action lawsuit where such participation is permitted by law. 13.5 Limitation Period Subject to applicable law, you agree to bring any claim or cause of action arising out of or related to these Terms or the Website within the time period required by the applicable statute of limitations. In Ontario, Canada, the Limitations Act, 2002 generally provides a two (2) year limitation period for most claims. GENERAL PROVISIONS 16.1 Entire Agreement These Terms, together with our Privacy Policy and any other legal notices or policies published on the Website, constitute the entire agreement between you and the Company regarding the Website and supersede all prior agreements, understandings, and communications. 16.2 Severability If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. You represent that: a) You are not located in, under the control of, or a national or resident of any country subject to Canadian or U.S. export restrictions or economic sanctions; b) You are not listed on any Canadian, U.S., or international prohibited or restricted party list; c) You will not use the Website or any downloaded software in violation of any export restrictions. 16.9 Language These Terms are drafted in English.
